By accessing or using the services and products of WEBMINDS SOLUTIONS, you agree to comply with and be bound by these terms and conditions. Your use of our services or purchase of products constitutes acceptance of these terms. If you do not agree with any part of these terms, please do not use our services or purchase our products.

"We," "us," or "our" refers to JOÃO PEDRO MOREIRA DE PÁDUA E SILVA, operating under the trade name "WEBMINDS SOLUTIONS," with an active business registration in Portugal, holding the taxpayer number (NIF) PT238377210, and located at Rua das vielas 51, Aveiro, Portugal.

These General Terms govern the submission of a request for services via our website www.webminds.pt (the "Site") and your registration for an account on the Site through which you can manage the services you receive. By submitting your details to us for account registration on the Site, you agree to be legally bound by these General Terms.
3. Description of Products and Services

- Dedicated Servers: Dedicated servers for maximum performance, security, and full customization.
- Reseller Hosting: Hosting for resellers, allowing you to offer hosting services to your own clients.
- Domain Registration: Domain registration with a wide selection of TLDs available.
- Domain Transfer: Domain transfer service ensuring a secure and seamless transition.
Services:
- We Build Your Website: Custom website building service, from design to implementation, to meet your business needs.
Security & Tools:
- SSL Certificates: SSL certificates to protect the communication between your site and its visitors.
- SEO Tools: SEO optimization tools to improve your site’s visibility on search engines.
- Site & Server Monitoring: Continuous monitoring of site and server to ensure maximum uptime and performance.
- NordVPN: VPN service to protect your internet connection and ensure online privacy.
4. User Responsibilities
Users are responsible for the proper use of the services and products acquired. This includes, but is not limited to:
- Maintaining the security of information and personal data related to the services.
- Ensuring that the content and use of the services and products comply with all applicable laws and regulations, including data protection laws (General Data Protection Regulation - GDPR).
- Not using our services for illegal activities, such as distributing malware, hacking, or infringing on intellectual property rights.
Although the server performs automatic backups twice daily, it is the user’s responsibility to download these backups to ensure their security and availability. WEBMINDS SOLUTIONS is not liable for data loss that may occur if the user does not regularly download the provided backups.
5. Payment and Billing
Users agree to pay the fees associated with the services and products acquired. Details regarding billing cycles, payment methods, and automatic renewal policies for subscriptions are available on our website. Failure to make payment within the established timeframe may result in the suspension or termination of services or the inability to purchase additional products.
If an invoice remains unpaid 5 days past its due date, a late fee of 10% will be applied to the outstanding amount. Under Portuguese law, users have the right to withdraw and may cancel the services or products purchased within 15 days from the date of purchase, provided that these have not been used. Beyond this period, no refunds are provided for unused periods or already purchased products, unless otherwise specified in our refund policy.
6. Website Building Service ("We Build Your Website")
6.1 Project Development
The average timeframe for developing a custom website by WEBMINDS SOLUTIONS ranges from 35 to 50 business days, which may be adjusted based on the project's specifications and complexity. This timeframe may be influenced by factors such as the need for additional revisions, integration of specific functionalities, or delays in receiving materials and information from the client.
6.2 Specifications and Approval
The client is responsible for providing all necessary information and materials for the website development within the stipulated timeframe. Failure to provide or delays in delivering these elements may result in an extension of the completion timeframe. Before final delivery, the client will have the opportunity to review and approve the completed work. Any changes requested after final approval may incur additional charges and a new delivery timeframe.
6.3 Payment Conditions
Payment for the "We Build Your Website" service will be made in two installments: an upfront payment of 50% of the total agreed amount at the beginning of the project, and the remaining 50% to be paid before the final delivery of the website. The start of development will only be confirmed upon receipt of the upfront payment.
6.4 Maintenance and Support
After the website delivery, WEBMINDS SOLUTIONS offers a limited period of support for technical adjustments and error corrections. Ongoing maintenance and technical support beyond this period can be contracted separately under agreed terms.
6.5 Cancellation and Refund
The client has the right to cancel the "We Build Your Website" service within 15 days from the date of purchase, provided that development has not yet started. If cancellation occurs after the start of development, a partial refund may be applied, calculated based on the work already performed and costs incurred.
7. Termination
We reserve the right to suspend or terminate services or cancel product purchases for violations of these terms or for any other justified reason. In the event of termination, you may lose access to content, data, and purchased products. Additionally, we reserve the right to seek legal action if your use of our services or products results in harm to our infrastructure, network, or reputation.
8. Limitation of Liability
WEBMINDS SOLUTIONS is not liable for any damages or losses resulting from the use or inability to use our services or products, except in cases of intentional misconduct or gross negligence as provided by Portuguese law. This includes, but is not limited to, direct, indirect, incidental, consequential, or punitive damages. While we strive to provide high-quality products and services, you acknowledge that there are inherent risks in using digital technologies and that you use our services and products at your own risk.
9. Changes to Terms
We may update these terms periodically, and continued use of our services or purchase of products constitutes acceptance of the updated terms. We will notify you of any significant changes via email or by prominently displaying a notice on our website. It is your responsibility to review these terms periodically to stay informed about any changes that may affect your use of our services or purchase of products.
10. Governing Law and Jurisdiction
These terms are governed by Portuguese law. For any disputes arising from the interpretation or execution of these terms, the competent jurisdiction is the Aveiro district court, with express waiver of any other jurisdiction.
